Terms and Conditions

Please read our "Terms and Conditions"(T&C) on our "General Booking", "Cancellation", "Payment"and "Other Terms"which apply to all bookings with "Scuba Quest Pte Ltd"(SQ).

SQ shall be construed to comprise of "The Company", "our Affiliates, our Officers, our Agents, our Employees, our Workers, our Directors, our Instructors, our Dive Professionals and our Representatives.

2.1 Customer/Trainee must produce their diving certification issued by any recognised organisation for verification.

2.2 Customer/Trainee must complete and sign the "SSI Liability Release and Assumption of Risk Form"prior to the commencement of any in water activities.

2.3 SQ requires Customer/Trainee to complete a "SSI Medical Questionnaire Form"upon booking of any diving program,irrespective of previous experience or training.

2.4 SQ is not permitted to issue any medical advice. Seek medical advice from a Certified Medical Practitioner when you are in doubt of any medical matter related to diving or otherwise before engaging in scuba diving or similar activities.

2.5 The maximum depth permitted on all SQ diving trips, 30 metres for certified Open Water Divers with Deep Adventure Dive certification, Advanced Divers, Rescue Divers, Dive Master and Instructors. Open Water Divers without Deep training will not be permitted to dive beyond the depth of 18 metres. Certified Deep Divers will be allowed to dive to the maximum recreation depth of 40 metres.

2.6 SQ reserves the right to modify and/or cancel any diving arrangements for the reason listed, but not limited to, those below:

2.6.1 The number of Customer/Trainee scheduled for the trip;

2.6.2 Weather conditions affecting the travel to the scheduled destination;

2.6.3 Other unforeseen circumstances.

2.7 Customers/Trainees who failed to participate in any dives on a dive trip or any program training dives, for whatsoever reason, shall not hold SQ to any liabilities for any reimbursement or replacement dives.

2.8 Customer/Trainee agrees to learn independently and to complete the specific learning as require by the dive program, which is also reiterated in emails from SQ. This includes completing all dive program learning objectives using the SSI Digital or E-Learning in advance before the commencement date of any workshop or practical as agreed. If Customer/Trainee arrives  without completing the necessary online learning, or if Customer/Trainee fails to arrive on time or Customer/Trainee failed to turn up on the agreed date and time, it may be necessary to rearrange to a later date. The Customer /Trainee will be liable for any additional cost for the rearrangement.

2.9 Safety is the utmost priority in SQ. If our Instructor's evaluation of any Customer/Trainee to be not competent to dive safely at the level that the Customer/Trainee are trying to achieve after the completion of the dive program, the Customer/Trainee WILL NOT be certified. PAYING FOR THE DIVE PROGRAM DOES NOT GUARANTEE CERTIFICATION.

3.1 Customer/Trainee are to ensure that they have a valid travel visa (if required) and an international passport with a minimum of six(6) months validity from the date of departure. Customer/Trainee will have to bear for any additional charges incurred by failing to ensure the necessary requirement.

4.1 Customer/Trainee are strongly advised to secure appropriate travel insurance with reputable insurance provider and applicable to the activities that the Customer/Trainee are undertaking. Such insurance should provide comprehensive coverage for, Diving, Medical, Travel, Personal Liability and Cancellation provisions. SQ shall not be held responsible for any financial or personal loss or injury, should the Customer/Trainee choose not to secure such insurance.

5.1 The number of dives in any dive package is an estimate based on normal diving circumstances, and not a guarantee. Where circumstances arise, such as, but not limited to; adverse weather conditions, personal illness, technical difficulties, dive site remoteness/inaccessibility or personal choice that causes a reduction in the estimated number of dives, there will be no refund in such circumstances.

5.2 Customer/Trainee must book and pay online or bank transfer to received a booking confirmation. If Customer/Trainee were to cancel within 90 days no refund will be given unless a replacement diver can be found. No refund in full or in part, exchange or fee adjustment will be made in respect of accommodation, meals, dives, transportation, equipment or any other service stated in the dive package which are not utilised. If SQ finds a replacement booking for you, a refund will be issued. The value of this refund will be based on the re-selling the cancelled slot less an administration fee of SGD 150. Cancellation slot will usually be sold at a discount from its original booking value.

5.3 SQ does not take responsibility or provide refunds for inclement weather and current conditions, poor visibility, acts of nature, airline strikes, wars or epidemics. However, in the event of a booking cancellation by SQ is due to insufficient of numbers, a full refund will be given to the Customers/Trainee. Customer/Trainee can also request to reschedule their booking to another date , subjected to availability.

5.4 No refund will be given for any medical or personal reasons that fall within 90days for all SQ bookings prior to commencement, unless a replacement booking is found.

5.5 SQ will do everything within its abilities to find a replacement booking, however SQ will not be held responsible in the event a replacement is not found.

5.6 SQ does not allow bookings to be transferred to another date, unless a replacement is found.

5.7 If a Trainee has paid for a dive program with open water package,and cancelled the the dive program or open water package within 90 days, the cost of the open water package will not be refunded unless a replacement is found.

5.8 If a Trainee cancels the open water package after the completion of theory and/or pool sessions, no refund will be granted.

5.9 Promotional dive program and dive package are NOT refundable.

5.10 SQ will not be liable for any refund if itinerary are alter due to any emergency evacuation.

6.1 Where it is due to the Customer/Trainee's negligence or irresponsible action, that resulted to any damage to, or loss of any property or equipment belonging to SQ, Customer/Trainee shall compensate SQ in full, based on the current market value for the damage or loss.

6.2 Customer/Trainee undertakes to be physically or emotionally or mentally prepared and the fitness to participate in the activities that they have signed up for. Any injury or discomfort borne out to be the result of lack of fitness, shall not warrant for any ground of complaint or refund.

6.3 Where Customer/Trainee does not seem to be physically or emotionally or mentally prepared or fit to dive, demonstrate a distinct lack of respect for or handle/harm marine life, consume alcohol in between dives, fail to abide any general international safe diving standards and practices, SQ or our Representatives or our Instructors or Dive Professionals, can exercise their rights to prohibit an individual's participation for any water activities.

6.4 When signing up for any SSI Dive Program, a Medical Questionaire Form will be issued to Customer/Trainee upon registration. It is the Customer/Trainee's responsibility to obtain a Letter of Authorisation to Participate form a Certified Medical Practitioner in the event that they have answered YES to any of the questions in the Medical Questionaire Form. Should Customer/Trainee failed to submit the Letter of Authorisation to Participate by their program commencement time, any deposit paid will be forfeited and the Customer/Trainee will be liable for any additional costs incurred.

6.6 It is the responsibility of the Customer/Trainee to be aware of the specific requirements of the dive program they have signed up for, as outlined in the emails from SQ and the information provided on DiveSSI website. If any Customer/Trainee is unable to complete or perform any of the required skills that are specifically mentioned in correspondence with SQ, the Customer/Trainee will not be able to proceed with the program, and as such any payment made will be forfeited and the Customer/Trainee will be liable for any additional costs incurred.

Under the Personal Data Protection Act 2012 (PDPA), it is mandatory to recognise both the rights of individuals, to protect their personal data, including rights of access and correction, and the needs for organisation to collect, use or disclose personal data for legitimate and reasonable purposes.

For this clause, Customer/Trainee is deemed to have agreed to be included in our mailing list once they have filled up any of SQ online Google Forms, or making payment with SQ for the booking of dive programs or dive packages or dive equipment.

SQ takes a consistent effort to take photos and/or videos of Customer/Trainee during every trip for marketing purposes and for sharing with other Customer/Trainee. By consenting for photos and/or videos to be taken by our photographer during the trip, Customer/Trainee are deemed to agree to the usage of their photos and/or videos on our social platform and collateral and the used for other marketing purposes. Should there be any concern on the use of their photos and/or videos for marketing purposes, Customer/Trainee may inform us in advance or during the trip.

By making payments/signed up for any dive programs/signed up for any dive packages, Customer/Trainee have deemed to have us to collect your personal data for any or all of the following purposes:

a) performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;

b) verifying your identity;

c) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;

d) managing your relationship with us;

e) processing payment or credit transactions;

f) sending you marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, lucky draws, membership and reward schemes and other promotions;

g) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any government agencies and/or regulatory authorities;

h) any other purposes for which you have provided the information;

i) transmitting to any unaffiliated third parties including our third party service providers and Agents, and relevant government agencies and/or regulatory authorities, whether in Singapore or aboard, for the aforementioned purposes; and

j) any other incidental business purposes related to or in connection with the above.

We may disclose your personal data:

a) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods and services requested by you;

or

b) to third party service providers, Agents and other organisations, we have engaged to perform any of the functions listed in the clause above, on behalf of SQ.

The purpose listed in the above clauses, may continue to apply even in situations where your relationship with us (i.e. pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

We generally do not transfer your personal data to countries outside of Singapore unless required for the organising of overseas travel or trips.

SQ reserves the right to change, alter and/or delete these terms and conditions as well as any program outlines without prior notification.
